SPM Development Services Ltd
Disciplinary and Dismissal Policy
May 2024
Introduction:
This policy provides a framework for addressing disciplinary issues that may arise with self-employed tutors and mentors engaged by SPM Development Services Ltd. It outlines the steps for managing these issues in compliance with UK legal standards.
Scope:
This policy applies exclusively to self-employed staff, tutors and mentors engaged by SPM Development Services Ltd.
Disciplinary Process:
1. Informal Resolution: Initial concerns are ideally addressed informally through direct communication to achieve a mutual understanding and remediation.
2. Formal Disciplinary Action:
– Investigation: A formal investigation will be initiated when serious breaches are reported. The individual will be informed of the allegations and given an opportunity to respond.
– Disciplinary Meeting: If required, a disciplinary meeting will allow the individual to present their case. This is a formal process taken when informal resolution is not feasible.
– Decision and Action: Outcomes may include a warning, a suspension of engagement, or termination of the contract, based on the severity of the misconduct.
3. Examples of Misconduct:
– Minor misconduct: Minor policy violations, tardiness, or failure to meet agreed standards.
– Gross misconduct: Severe breaches such as confidentiality violations, unethical behaviour, or actions that significantly harm the business or its clients.
4. Dismissal: Considered in cases of gross misconduct or repeated breaches. The process will be transparent, adhering strictly to the terms of the contractual agreement.
5. Right to Appeal: Engaged individuals can appeal a disciplinary decision within 14 days, outlining their grounds for appeal. The appeal process will be clearly detailed, ensuring fairness and transparency.
Guidelines for Managing Disciplinary Issues
– Thorough documentation of all proceedings for transparency.
– Timely resolution to minimise disruption.
– Adherence to UK legal standards, particularly respecting the rights of self-employed individuals.
Review and Amendment
This policy will be reviewed annually to align with current laws and best practices, with amendments as necessary to address changes in legal requirements or operational structure.
